By accessing and/or using the Elite Agent Platform, you agree to be bound by these Terms and Conditions (“Terms”), establishing a contractual relationship between you and Elite Agent Agency. If you disagree with any part of these Terms, you must immediately notify Elite Agent Agency to cancel your account and cease accessing the Elite Agent Platform.
Elite Agent Agency reserves the right to modify these Terms at any time without notice. Continued use of the Elite Agent Platform after such modifications constitutes acceptance of the updated Terms.
Elite Agent Agency may terminate these Terms and/or access to the Elite Agent Platform, or cease offering the Platform, at any time and for any reason.
Terms of Use Agreement:
Access to any of Elite Agent Agency’s websites constitutes agreement to the Terms of Use and Privacy Policy, forming a binding contract between you and Elite Agent Agency.
Disclaimer:
All materials provided by Elite Agent Agency are offered “as is” and “as available” without warranty of any kind, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Elite Agent Agency and its affiliates shall not be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your use of the Elite Agent Platform.
Third Party Websites:
Links to third-party websites provided on the Elite Agent Platform are independent of Elite Agent Agency, which assumes no responsibility for their content or activities. Use of third-party websites is at your own risk.
Liability, Warranties, Representations, and Indemnification:
Your use of the Elite Agent Platform is at your sole risk. Elite Agent Agency disclaims any warranties or representations regarding the accuracy, reliability, or availability of the Platform.
You agree to indemnify and hold Elite Agent Agency harmless from any claims, liabilities, and expenses, including legal fees, arising from your use of the Elite Agent Platform or any breach of these Terms.
Automatic Renewal:
Subscription to the Elite Agent Platform will automatically renew at the end of each term, unless canceled before the renewal date. By subscribing, you agree to automatic renewal and the associated charges.
Leads:
Elite Agent Agency does not guarantee the quantity or quality of leads generated through its services. Users should expect variations in lead generation, including spam and inaccurate information.
Spam Emails:
Elite Agent Agency complies with applicable regulations regarding commercial electronic messages. Users are prohibited from using the Elite Agent Platform to send unsolicited messages.
Jurisdiction:
These Terms shall be governed by the laws of Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts ofCanada.
Termination:
Either party may terminate these Terms at any time with written notice. Upon termination, any outstanding fees shall become immediately due, and access to the Elite Agent Platform will cease.
Refund Policy:
Elite Agent Agency does not offer refunds for partial months or unused accounts. Recurring fees are non-refundable.
Website Status After Cancellation:
Upon cancellation, clients will no longer have access to the website or CRM. The website and CRM data will be deleted immediately, and the domain will no longer be hosted on Elite Agent Agency’s servers.
Additional Requirements and Payments:
Any modifications beyond basic customization may incur additional fees. Clients are responsible for covering such development costs.
Plan Change:
Clients may request changes to their subscription plans, subject to availability and any associated fees.
Changes to Services and Pricing:
Elite Agent Agency reserves the right to modify services and pricing at any time. Users will be notified of changes in advance.
Revisions:
Elite Agent Agency may revise these Terms at any time. Users are bound by the most recent version of the Terms, which can be reviewed periodically on the Elite Agent Platform.
